Judge rules county must pay for repairs to 6 dams
August 27, 2019By The Associated Press
PERU — A judge has ruled that a northern Indiana county must pay for repairs to six aging dams in a lake-filled housing development.
The Indiana Natural Resources Commission had determined that the Department of Natural Resources had the authority to require property owners and Miami County to fix dams in the Hidden Hills subdivision.
After the property owners appealed, a Marion County judge found that the DNR has the authority to require the repairs. But the Kokomo Tribune reports the judge also found that Miami County was fully responsible for those repairs.
The judge said the county must maintain those roads because all six dams have roads built across them and they're part of the county system.
